Richard Friedman s Seminal Work, Crime And Punishment Essay

Several themes emerge from the course Frontier Justice that match well with the major themes in Lawrence Friedman’s, seminal work, Crime and Punishment in American History. His main thesis is that judgements about crime and what to do about it come from a specific time and place. Part of his work addresses the history of criminal justice in which he calls, the history of power. He identifies the relationship between crime, criminal justice and American culture. When one looks at the frontier West and its dynamics, one can see how those in power bent and at times broke the law in order to achieve their aims. Culture played an important role in many part of the West which was a far different culture than the one found in the East. This different culture resulted from the dynamics of Westward expansion and had dramatic role in shaping the West. Certainly, the frontier West can be described as both a time and place. Many have romanticized views of what the West was like. The historian Robert Utley wrote, â€Å"historical reality lies somewhere between the extremes†. My friend Garret always seems to fidget and sweat throughout a movie when watching it with friends. Usually handpicked by himself, he proudly pronounces his love and affection for it as the best piece of cinema to ever be blessed to this world. But upon popping in the movie, his confidence quickly disappears. He sweats vigorously and repeatedly shakes his right leg up and down. He constantly watches us like a hawk, observing our every reaction, hoping it’s the appropriate one. He’ll laugh harder at what’s funny, act serious at what’s dramatic, and sigh heavily at what’s sad. It became clear that his goal of showing us this movie maybe to see us be entertained by it. Of Mice and Men Of Mice and Men "A guy goes nuts if he aint got nobody. Don't matter no difference who the guy is, long's he's with you. I tell ya a guy gets too lonely an' he gets sick." A major theme in Steinbeck's novella Of Mice and Men is loneliness. The characters Crooks, Candy and Curley's wife each suffer from this although the severity of their seclusion varied. The old swapper, Candy was victimized by isolation as a result of two main factors, one being his disability and the other being his age. For example, throughout the book we find the farmhands out bucking the barley while Candy is left behind to sweep and clean the ranch. He lost his hand after getting it caught in a piece of machinery and as a result he is forced to stay behind. This being one of the major factors that leads to his loneliness. Furthermore, Candy's age adds to his feeling of uselessness. Because he thinks that he is old he puts himself in a state of mind that handicaps him more than his missing hand ever will. He looks down on himself as an old worthless man that's wasting away his last few years. Not only is it the way that others think of him but also the way he thinks of himself that forces him to find solitude. The most evident case of loneliness is Curley's wife. No matter how hard she tried she couldn't fit in. For example, when she tried numerous times to talk to George and Lenny she was either ignored or told to leave. Because of her reputation for being a flirt none of the farmhands wanted to talk to her. It was the threat of getting in trouble with Curley that caused many workers to avoid her. In addition, because of Curley's insecure feelings he neglected her and forced her to seek attention anyway she could, even it meant flirting. She was ignored by both the farmhands and her own husband and because of this she was being forced into loneliness, the one thing she fought so hard against. Crooks is a black man that experiences isolation in terms of racism. For example, he is forced to live alone in the barn. Because the setting of this book takes place during the 1930's discrimination sadly still existed. The farmhands feel that since he is black he isn't worthy of living with the rest of them. Furthermore, his separation from others causes his severe loneliness. He spends his nights reading and his days alone in the barn working on the horses. His distance from others eventually causes his downfall. We find discrimination being the major cause of this characters loneliness. He is treated as an outcast and underling and is forced to find friendship in the only thing he can, the books he reads. Loneliness is an inevitable fact of life that not even the strongest can avoid. Throughout the story Of Mice and Men we discover the many sources of solitude, primarily being discrimination and prejudice. Crooks, Candy, and Curley's wife all suffer from these facts which leads them to their loneliness. As for the consequences we find that the severity of each characters loneliness varied and that the eventual effects were directly related to the magnitude of their desolation.

When young teenagers are exposed to the images of violence, the personality of these young teens tend to become more aggressive and traumatic in their characteristics over the long run. At the same time, the emergence and exposure of video games with war images and weapons have brought serious issue to the society, the school and the young children themselves. Over the years, technology has progressed from being merely a form of practical functions to forms of entertainment, such as computer and video games. Since the commencement of these technological advancements, our lives have become significantly more convenient. However, as technology has considerably developed, it has had detrimental effects on members of society, especially on youth. Young people now identify social internet networks, video games, cell phones, and numerous other electronic amusements as essential technological devices. Nevertheless, juveniles are utilizing these electronic devices in a misguided manner, resulting in an increase of negative outcomes in this age group. Technology has adversely influenced how youths manage their time. Younger children’s daily routine is often regulated by parents, but after outgrowing the early stage, young people are given more freedom and authority to set their own limits. Now being free of their parents’ supervision they are now taking advantage of their freedom by playing video games continuously. Rather than using their time productively, the majority of teens boundlessly play video games, go on Facebook, and text on their cell phone. Many even carelessly use their time by texting discretely in school all day. Most teenagers are aware that they are consuming an excessive amount of their time on mass media, but they do not bother to modify their behaviour. This addictive pattern contributes to many factors of failures in a youth’s life. As the degree of usage of technology started to augment in recent years, bullying in cyberspace has increased correspondingly. Bullying through the medium of social networks has become widely known as cyber bullying and known also as the most severe issue since existence of bullying. Parents may feel outsmarted or overwhelmed by their children’s computer and Internet abilities, or they may not appreciate that the ‘new medium’ is an essential component of the new literacy, something in which their children need to be fluent. These feelings of inadequacy or confusion should not prevent them from discovering the Internet’s benefits. The dangers inherent in this relatively uncontrolled ‘wired’ world are many and varied, but often hidden. These dangers must be unmasked and a wise parent will learn how to protect their children by immersing themselves in the medium and taking advice from the many resources aimed at protecting children while allowing them to reap the rich benefits in a safe environment. Whenever you see wind gusts in your forecast, it means the National Weather Service has observed or expects wind speeds to reach at least 18 mph, and the difference between the peak winds and the lulls to vary by 10 mph or more.  A related phenomenon, a squall, is (according  to the National Weather Service), A strong wind characterized by a sudden onset in which the wind speed increases at least 16 knots and is sustained at 22 knots or more for at least one minute. Why Does the Wind Gust? There are a number of things that disturb wind flow and make its speed vary, including friction and wind shear. Protection Against Elderly Mistreatment Elder Mistreatment Laws Carolyn M. Hay Elder mistreatment is an issue that receives more recognition every year, but what many may not know on the subject are the laws and actions taken against elder mistreatment. In the United States, they take this issue quite seriously and have several acts that contribute to the research and prevention of elder mistreatment. They also provide services to help those who are victims of elder abuse and give justice to those who have been hurt. These laws include the Older Americans Act, the Omnibus Budget Reconciliation Act, and the Elder Justice Act. Each of these acts have their own personal mission and provide services to the elders who have been abused or mistreated, whether at home or in a healthcare setting. What is very concerning is that not many people, adults and elders alike, know about these laws and do not reach out for help when it is there for them. Older Americans should be aware of these laws and what each of them provides in terms of protection from abuse and also justi ce for the abuse done unto them. The first act is the Older Americans Act (OAA) that was passed in 1965. This act is what created the Administration on Community Living (ACL) whose mission is to, â€Å"develop a comprehensive, coordinated, cost effective system of home and community-based services that helps elderly individuals maintain their health and independence in their homes and communities† (Dong, 2012, p. 2152). But what does this entail exactly? Well the OAA gives grants to the states and local agencies for research and community planning programs for aging and elder abuse. The act has four parts to it that relate to elder mistreatment including Titles II, III, IV, and VII. Title II of the OAA states that the ACL must select someone to be in charge of the research, planning, and developing of elder abuse programs. Title III says that states must have a plan for the grants before they can receive them and then provides them with the grant. Title IV allows the ACL to give grant money for outreach progr ams and projects that relate to elder abuse. Lastly, Title VII makes the ACL give grants to state agencies to educate the community on elder abuse, including caregivers and other professionals. This title also makes the state have someone to take care of the legal services associated with elder abuse and protection. Overall, what the OAA act does is mandates these elder abuse programs in the states and provides the funding for them (Dong, 2012, p. 2152-2153). The second act is the Omnibus Budget Reconciliation Act, or known as the Nursing Home Reform Act, and was passed in 1987. This law was made to ensure the highest quality care for the elderly living in nursing homes. â€Å"The law ‘provides federal statutory protection for residents in certified nursing facilities†¦Residents have the right to privacy, information on medical changes, the right to voice grievances without discrimination, and accommodation of physical, emotional, and social needs,†Ã¢â‚¬â„¢ (Watson, 2013, p. 41). Because of this protection, this law is considered to be the most important law that deals with elder abuse. This seems plausible, because many reported cases of elder abuse occur in long term care facilities and nursing homes. This law is substantial because it makes it okay for the elderly living in nursing homes to protect themselves and receive the highest quality care that they deserve (Watson, 2013, p.41). The most recent and last act is the Elder Justice Act, which was passed in 2010 as part of the Patient Protection and Affordable Care Act. This act allows a federal response to elder abuse through community services to help with the prevention, detection, and treatment of it. This act was the first time that Congress addressed elder mistreatment at the federal level. One of the several great parts of this act is the creation of a Nation Training Institute for Surveyors and the provision of grants to the state survey agencies. These surveys are conducted on long-term care facilities for their care of the patients and the health of the residents to make sure that the minimum standards are being met. This is great because these agencies could detect elder abuse in the facility and take necessary action to protect the residents living there. Hopefully this act will lead to bigger and better things in terms of justice for elder abuse in the United States (Colello, 2014, p. 2-9). Now we know what is being done in present time to prevent elder abuse and give justice to those who have been abused, but what needs to be done in the future? First of all, more research needs to be done on the population of the United States to look at the incidence of elder abuse and the risk factors associated with elder abuse. New research should focus on the risk factors associated with the elderly, like dementia, and also the risk factors associated with the abuser, like the work setting. Secondly, the United States must look at elder mistreatment across all cultures and minorities in the country. Again, this research needs to focus on the risk factors and the incidence of elder abuse within each minority. Another factor that needs to be looked at is the rates for which elder abuse is being reported in each minority. With this information we can hope to get a better understanding of elder abuse across the United States, including all of the different minorities and cultures tha t coincide there. With a better understanding, we can raise awareness in all cultures about elder abuse and what can be done to prevent it and give justice to the victims of abuse (Dong, 2012, p. 2153-2154). In conclusion, these three laws are there to protect and give justice to elders that have been abused, and our elderly population should be educated on each of these laws. Each act is associated with elder abuse, but has different actions. The Older Americans Act provides the funding and helps with the planning of elder abuse programs and research in every state. Women are the inherent part of our society and cannot be neglected due to their less power and authority. They are created as a companion for men and men have to make her walk with them in the course of life. They play their roles with great responsibilities in upbringing of a healthy solid society, but she is in our so called modern world, still living in chains. The basic unit of society is a woman. As woman makes a family, family makes a home and homes make a society. So we should never think that a society would come into existence without the contribution of women. We all know that without education, no development is possible. Here we have forgotten that the very first and best school of a child is its mother’s lap. A good healthy society doesn’t automatically emerge on its own and stands firm but it needs to be emerged and for its emergence women play a pivotal role. From behavioral to health education women have their hands in. t’s a woman who teaches how to behave, how to speak and how to deal with different classes of people. These all are the basic fundamentals of a good society and women are the main contributors in building up a strong society. They are given basic education as well as fundamental and higher education without any restrictions from the society. That is why the West is that much developed. As they are educating and encouraging both the sexes equally and discriminating none. Like this there is competition and where there is competition there is invention and invention leads to massive developments. Pakistan is an Islamic country and exists and functions in the context of its unique set of historical, social, economic and political circumstances. Women within Islamic boundaries can take part in all activities weather they belong to financial, national, international, social or domestic affairs. Women population of our country is greater than that of men population. If such a big portion of population is kept behind then it’s difficult to progress with due speed and we will obviously lag behind the developed countries. Pakistan is an under developed country and most of its population is of the youth. It’s a golden chance for Pakistan to rightly utilize the youth’s energies. Women are more productive than men; if in Pakistan they are given the right platform they will smoothly carry the nation towards development. The role of Pakistani women in their families revolves around well-established conventions of male supremacy and female sub ordinance. Here the complete responsibility lies on the shoulders of the male to educate and encourage the females to step forward and to play their role in developmental processes. Women are not only for home-making and child-rearing but they must also be given chance to put their hands a little forward in building up of a good solid society. A good solid society is a good harbinger of development. The patients who had purely psychological explanations were the least likely to seek help. Because of this, Cheung recommended that clinicians specifically inquire about psychological symptoms, because these patients were not likely to volunteer them. Special Issues in Assessment Professionals working in systems that link treatment and corrections must be aware of a broad range of special issues in assessment related to clients’ gender, culture, ethnicity, sexual orientation, educational level, religious affiliation or spirituality, and other such sociocultural characteristics. Issues related to a number of these characteristics are discussed below. Language It may be necessary to perform the assessment in the primary language of the individual, which may not be English. Assessors should avoid the assumption that a speaker of any given language can also read that language. The client may not be functionally literate in any language. While minor differences exist in various versions of the tale, such as those between Joseph Jacobs' and Horace Elisha Scudder's versions, the tale can always be read as Jack's quest for maturity. Some critics, however, analyze the tale as one in which Jack remains spoiled and immature. While they make points which support their claims, careful analysis of the tale will reveal that Jack's struggle to grow up and to achieve maturity is representative of the difficult process of adolescent (especially male) maturation and the process of adolescent socialization.            Some critics, as previously stated, maintain that Jack does not mature or learn any lesson during the tale. For example, Nell B. Byers writes that Jack is "a fellow who makes what would not be thought of as a prudent investment; who is not above trickery in outwitting the giant's wife; who steals the giant's treasures; and who, having killed the giant, lives with his mother happily ever afterward in affluence" (26). Byers' statement would lead one to believe that Jack does not change very much. Granted, a literal reading of most versions of the tale supports Byers' statements. Jack appears to be an immature, spoiled brat, or worse. Notably heart disease is a significant health problem that not only costs lives but is a significant economic burden with costs related to doctors’ visits, medications, rehabilitation and additional contributors such as loss of work and patient rehabilitations. It is estimated at approximately 485 billion dollars annually can be associated to the treatment of heart related issues such as heart attack and CHF, early diagnosis is imperative (Heart,2013). The intention of this proposal is to introduce the function of Point of care (POC) testing in the Emergency Department for immunoassay levels and educate on the benefits of early detection of Troponin and Brain naturietic peptide levels which are cardiovascular disease markers. This proposal outlines the purpose, targeted population, costs, and benefits as well as the process of evaluation. Furthermore, acquiring approval of the Emergency Department manager as well as the director is the intention of this proposal and it is hoped that the program once approved can be launched in June of 2015. Looking at these statistics it is imperative that having POC testing to rule out benign conditions and reserve resources for true life threating cardiac issues. The purchase price for the POC device is approximately 6,000 dollars which based on a study translated into approximately 9.00 to per person to perform the test which is very inexpensive( Mainor,2002). Benefits Benefits of this program is receiving funding for the purchase of the POC testing equipment, resulting in the ability to rapidly evaluate patients presenting with cardiovascular symptoms, such as suspected acute myocardial infarction or heart failure. Utilizing POC testing into an emergency department results in quicker diagnosis, treatment, improved patient outcomes, improves ER flow through by weeding out non acute patients, decreases unnecessary use of resources such as medication and  hospital admissions. Evaluation In order to assess if this program will be successful we can survey a control group to see if the statements that are made are accurate. In surveying 100 patients that present with cardiovascular symptoms such as chest pain. POC testing can be completed to see how many of the 100 patients were non acute chest pain resulting in the reduction of resources and admissions. In addition, research from other facilities is widely available and research has already been completed ensure the success of this program. Conclusion POC testing is an easy, quick intervention that leads to quicker diagnosis and the savings of vital resources need for life threatening emergencies. This department needs to have this machine, the improvement of ER flow by reducing non acute patient wait times would be only one of many invaluable reasons to approve and fund this program.
