Richard Friedman s Seminal Work, Crime And Punishment Essay

Several themes emerge from the course Frontier Justice that match well with the major themes in Lawrence Friedman’s, seminal work, Crime and Punishment in American History. His main thesis is that judgements about crime and what to do about it come from a specific time and place. Part of his work addresses the history of criminal justice in which he calls, the history of power. He identifies the relationship between crime, criminal justice and American culture. When one looks at the frontier West and its dynamics, one can see how those in power bent and at times broke the law in order to achieve their aims. Culture played an important role in many part of the West which was a far different culture than the one found in the East. This different culture resulted from the dynamics of Westward expansion and had dramatic role in shaping the West. Certainly, the frontier West can be described as both a time and place. Many have romanticized views of what the West was like. The historian Robert Utley wrote, â€Å"historical reality lies somewhere between the extremes†. As one examines everything in between, what emerges from the comparison of Friedman’s work and that of frontier justice, is a question of what were the causes of violence in the West. Before the frontier closed, it could be described at times as a lawless land influenced by the lawful law and the lawless law. The causes of this violence are as diverse as the West itself. My friend Garret always seems to fidget and sweat throughout a movie when watching it with friends. Usually handpicked by himself, he proudly pronounces his love and affection for it as the best piece of cinema to ever be blessed to this world. But upon popping in the movie, his confidence quickly disappears. He sweats vigorously and repeatedly shakes his right leg up and down. He constantly watches us like a hawk, observing our every reaction, hoping it’s the appropriate one. He’ll laugh harder at what’s funny, act serious at what’s dramatic, and sigh heavily at what’s sad. It became clear that his goal of showing us this movie maybe to see us be entertained by it. I’ve noticed many other people, including myself, having similar reactions in these same situations. It’s so bizarre that we tend to watch other people’s reactions so closely when sharing what’s dear to us with them. When you think about it, why do we care so much about what others think of what we like? If someone doesn’t enjoy our interests, who cares!? It’s their loss; we can continue to enjoy that content without them. But on the other hand, maybe there’s more to it than that. The term might be considered academic jargon; however, it produces up a set of expectations that allow us to judge literature. These expectations or criteria also allow us to compare with other literature in the same as well as different genres. In spite of these expectations, genre does not dictate a set of rigid rules; in fact, genre is more descriptive than prescriptive. Problems in defining genre often arise because there are frequently sub-genres: romantic comedy might be considered a sub-genre of comedy, revenge tragedy of tragedy and gothic horror of horror. It becomes increasingly difficult to see where one sub-genre ends and another begins. Also these categories are seldom pure. For example, Hamlet, a revenge tragedy, includes aspects of romance and even a comic scene or two. Our popular culture makes defining genre challenging because what is vital one day might disappear the next. An example of this is the current insistence upon a happy ending. Since tragedy is often characterized by an unhappy or right ending, according to Aristotle, popular culture no longer welcomes the tragedy with the relish it did at other times in history. Of Mice and Men Of Mice and Men "A guy goes nuts if he aint got nobody. Don't matter no difference who the guy is, long's he's with you. I tell ya a guy gets too lonely an' he gets sick." A major theme in Steinbeck's novella Of Mice and Men is loneliness. The characters Crooks, Candy and Curley's wife each suffer from this although the severity of their seclusion varied. The old swapper, Candy was victimized by isolation as a result of two main factors, one being his disability and the other being his age. For example, throughout the book we find the farmhands out bucking the barley while Candy is left behind to sweep and clean the ranch. He lost his hand after getting it caught in a piece of machinery and as a result he is forced to stay behind. This being one of the major factors that leads to his loneliness. Furthermore, Candy's age adds to his feeling of uselessness. Because he thinks that he is old he puts himself in a state of mind that handicaps him more than his missing hand ever will. He looks down on himself as an old worthless man that's wasting away his last few years. Not only is it the way that others think of him but also the way he thinks of himself that forces him to find solitude. The most evident case of loneliness is Curley's wife. No matter how hard she tried she couldn't fit in. For example, when she tried numerous times to talk to George and Lenny she was either ignored or told to leave. Because of her reputation for being a flirt none of the farmhands wanted to talk to her. It was the threat of getting in trouble with Curley that caused many workers to avoid her. In addition, because of Curley's insecure feelings he neglected her and forced her to seek attention anyway she could, even it meant flirting. She was ignored by both the farmhands and her own husband and because of this she was being forced into loneliness, the one thing she fought so hard against. Crooks is a black man that experiences isolation in terms of racism. For example, he is forced to live alone in the barn. Because the setting of this book takes place during the 1930's discrimination sadly still existed. The farmhands feel that since he is black he isn't worthy of living with the rest of them. Furthermore, his separation from others causes his severe loneliness. He spends his nights reading and his days alone in the barn working on the horses. His distance from others eventually causes his downfall. We find discrimination being the major cause of this characters loneliness. He is treated as an outcast and underling and is forced to find friendship in the only thing he can, the books he reads. Loneliness is an inevitable fact of life that not even the strongest can avoid. Throughout the story Of Mice and Men we discover the many sources of solitude, primarily being discrimination and prejudice. Crooks, Candy, and Curley's wife all suffer from these facts which leads them to their loneliness. As for the consequences we find that the severity of each characters loneliness varied and that the eventual effects were directly related to the magnitude of their desolation.
